Dec. 20, 2011: The court entered a default judgment against Nicole Webster. She received a $500 fine, a $10 surcharge and had 6 points assessed against her license.

Dec. 21: Marvin D. Lee entered a no contest plea to charges of reckless driving, driving without valid license and failure to give immediate notice of accident. Magistrate Burrell fined the defendant $1,000 with $500 suspended, 120 days in jail were suspended, two $50 surcharges and restitution were to be paid and he was placed on probation for two years with conditions. On the second charge the defendant received a $500 fine with $250 suspended, 30 days in jail with 30 days suspended and a jail surcharge of $50 was to be paid. On the third charge the defendant was fined $200 with $100 suspended, jail time of 30 days was suspended, a jail surcharge was to be paid and conditions of probation were the same on all three counts. Lee’s operator’s license was revoked for one year.

Jennifer Kadake appeared on charges of Assault 4. She entered a not guilty plea and was released on her own recognizance (O.R.) with conditions.

Dec. 22: Richard Haerling entered a no contest plea to no proof of insurance and was sentenced to a fine of $250 and a surcharge of $10.

Jan. 5, 2012: William R. Craig entered a no contest plea to disorderly conduct charges.

The court ordered jail time of 5 days with 5 suspended, a fine of $300 with $200 suspended, two surcharges of $50 and $100 and was placed on probation for one year with conditions.

Brandon Estes entered a not guilty plea to charges of driving while license suspended, cancelled or revoked and no proof of insurance charges.

Tore K. Lenz entered a not guilty plea to minor consuming alcohol habitual.

Brandon Estes appeared on charges of driving while license cancelled, suspended or revoked and no proof of insurance. The defendant entered a not guilty plea and was released O.R. with conditions.

Ian R. Hamilton entered a not guilty plea to negligent driving charges. He was released O.R. with conditions.

Matthew B. Boseman’s summons date on two petitions to revoke probation were changed.

Tamara L. Pickhardt’s summons on Assault 4 charges was changed. A police investigation is on-going.

Jan. 10: The Petersburg Police Department sought an arrest warrant in the amount of $50,000 for Juan Carlos Murillo-Garcia. PPD filed a complaint for misconduct involving a controlled substance in the 6th degree, a class C felony. They alleged the defendant was trying to hire a fishing boat to take him out of town.

Levi Newman appeared before Magistrate Burrell on a second amended petition to revoke bail and theft 2 felony charges. Bail was set at $5,000 cash only performance bond and a $2,500 appearance bond and was released O.R. with conditions.

Kate Einerson appeared on a theft 2 felony charge and was released on bail of $1,000 performance bond, cash only, with conditions.

Jan. 11: Juan Carlos Murillo-Garcia appeared before Magistrate Burrell on felony charges. The court set bail at $25,000 appearance bond and a $15,000 cash performance bond.

Jan. 12: Garrett Lewis entered a not guilty plea to charges of reckless driving and no proof of insurance. He was released O.R. with conditions.

Jan. 19: Hoy Yi appeared on charges of negligent driving. He entered a not guilty plea and was released O.R. with conditions.

Robert J. Boseman entered a not guilty plea to a failure to appear charge and was released O.R. with conditions.

Jan. 23: Magistrate Burrell sentenced Stephen Frentz to pay a $150 fine for conviction of a dog running at large case brought by the City of Petersburg.

Judge Carey heard the custody hearing between Lena Logan and Jeremy Allgeyer. The court ruled it in the interest of the child to have custody awarded to the mother.

Jan. 24: Judge Carey heard the status hearing for Renee Deann Lester. The court allowed Lester to return to Petersburg with a significant list of conditions imposed, including that she check-in with the PPD once/week and submit to breath or UA test upon reasonable suspicion.

Judge Carey awarded primary legal custody to the father following a hearing involving Edward and Barbara Tagaban.

Delia Jane Dement appeared before Judge Carey on assault 4 and repeat minor consuming alcohol charges. The defendant pled guilty to reduced charges of disorderly conduct and the MCA charge was dismissed. The court imposed sentence of 10 days in jail, 80 hours of community work service, a $50 surcharge, a jail surcharge of $100 and costs of appointed counsel of $200.

Robert J. Boseman appeared before Judge Carey on a change of plea. The defendant entered a guilty plea to the DUI charge and the proof of insurance charge was dropped. He was sentenced to 30 days in jail with 27 suspended, a fine of $3,000 with $1500 suspended, drivers license revoked for 90 days, the cost of jail payment of $300, installation of an ignition interlock device (IID) for six months, a surcharge of $75, a jail surcharge of $100 with another $100 suspended, cost of appointed counsel, $200 and was placed on probation for one year with conditions.

Fredrick E. Haltiner Jr. appeared before Judge Carey on a charge of DUI and assault 4. The court found the actions of the defendant were totally out of character and found it hard to fathom after a lifetime of staying out of trouble. Haltiner was sentenced on the DUI count to 90 days in jail with 85 suspended, a fine of $1,500, $300 for cost of jail, $75 surcharge, a $50 surcharge, installation of an IID for six months, 90 day license revocation and was placed on probation for two years with conditions. On the assault charge the defendant was sentenced to 120 days in jail with 90 suspended, no fines or surcharges and was placed on probation for two years with conditions. Jail time in the two cases was to be consecutive.

Jon Travis entered a guilty plea to a reduced charge of driving without valid operator’s license. He was sentenced to 40 days in jail with 35 suspended, one year probation with conditions and ordered to pay two $50 surcharges.

Shane R. Lohr entered a change of plea for commercial fishing license falsification and unsworn falsification charges. He pled guilty and was sentenced to a $1000 fine, a $50 surcharge and could hold no fishing crew license for two years.

Jan. 25: Roderick M. Vasquez appeared before Judge Carey on a charge of failure to stop for a school bus. The defendant entered a guilty plea to reduced charges of negligent driving. The defendant was fined $300.

Joan L. McKnight appeared before Judge Carey who dismissed both charges of driving while license suspended, cancelled or revoked and violating conditions of release. The defendant was a legally licensed driver.

Judge Carey accepted the guilty plea of Andre M. Franklin on assault 4 charges. He was sentenced to 90 days in jail, 75 suspended, paid three surcharges of $200 and was placed on probation for two years with conditions.

The court sentenced Jason L. Ratliff on assault 4 charges that were reduced to a charge of harassment. He was sentenced to 90 days in jail with 90 suspended, a $50 jail surcharge, another surcharge and an additional surcharge of $100 was suspended. He was placed on probation for one year with conditions.

Gordon Lyons appeared on three counts of assault 4. The defendant entered guilty pleas to amended charges of disorderly conduct and reduced charges of harassment. On the disorderly conduct count the defendant was sentenced to 10 days in jail and payment of a $50 jail surcharge. Count 2 was dismissed. On the harassment charge the defendant was sentenced to 90 days in jail with 90 suspended, a $50 surcharge on each case and a jail surcharge of $50. He was placed on probation for 3 years with conditions and was to pay $200 for appointed counsel concurrent with both cases.

Judge Carey heard the competency hearing of Levi Newman.

Judge Carey heard oral arguments in the case Hanson-Tagaban vs. City of Pelican involving attorneys Fred Triem and Vance Sanders. The city allegedly foreclosed on property without notifying lien holders.
